Manning Enterprizes warranties to owner that all work performed will be free from defects in workmanship or materials for a period of five (5) years from final contracted date.
 

This 5-year Warranty is specifically limited as follows:

1. To work that has not been subject to accidental damage, misuse, abuse or to any other use other than         ordinary wear and tear.
2. To work that has not been modified, altered, defaced or had repairs made or attempted by others than         Manning Enterprizes.
3. That Manning Enterprizes is immediately notified in writing within ten (10) days of first knowledge of             defect by the owner or his agent.
4. That Manning Enterprizes shall be given first opportunity to make any repairs, replacements or                     corrections to the defective work at no cost to the owner within a reasonable period of time.
5. Under no circumstances shall Manning Enterprizes be liable by virtue of this Standard Limited Warranty       or otherwise for damage to any person or property whatsoever for any special, indirect, secondary or           consequential damages of any nature however arising out of the use or inability to use because of defect     in the work.
6. Exclusions from Standard Limited Warranty:

• Materials covered by manufacturer warranty and reoccurring maintenance items.
• Materials furnished by owner for installation and pre-existing materials.
• Damage resulting from mold, fungus and other pathogens not solely or directly caused by original                contractor’s work.
• Naturally occurring degradation of materials due to normal wear and tear.

 

This Standard Limited Warranty is in lieu of, replaces and supersedes to the full extent permitted by law any other warranty(ies) with respect to the work, whether express, implied, statutory or otherwise of any nature whatsoever and is non-transferable.
